Crítica de los fundamentos éticos para la obediencia y desobediencia al Derecho

Abstract

Este trabajo se dirige a clarificar, a través de un estudio de las corrientes de pensamiento más significativas para la Filosofía del Derecho, si existen propiamente fundamentos éticos de obediencia o desobediencia al Derecho, y, en su caso, en qué clase de ordenamiento pueden localizarse. Para ello, se realizará un examen de las posibilidades que el pensamiento jurídico puede ofrecer a lo largo de su evolución, desde el Derecho natural, como contenido esencial de justicia, hasta el triunfo del Derecho positivo, finalmente desembocando en los caminos abiertos por la Hermenéutica. En definitiva, el objetivo será profundizar en las posibilidades de la Ética como fundamentación última del Derecho, alumbrando nuevos problemas y posibles respuestas ante la cuestión planteada.

This project aims to clarify, through a research on the most meaningful lines of thought within the Philosophy of Law, the actual existence of ethical foundations for the obedience or disobedience of Law, and, in such case, in what kind of legal order they may be located. To this effect, an assessment will be conducted on the possibilities offered throughout the evolution of legal thought, from natural law, as an essential content of justice, until the triumph of positive law, leading into the new paths opened by hermeneutics. In short, the purpose will be to deepen into the possibilities of ethics as the ultimate foundation of Law, elucidating new problems and possible answers to the matter raised here.
