La protección el consumidor y su encaje en las Constituciones española e italiana. Un análisis de los instrumentos de tutela colectiva

Abstract

El presente trabajo tiene por objeto estudiar el reflejo que la protección del consumidor tiene tanto en la Constitución italiana como en la española con especial atención a los mecanismos procesales de acción o tutela colectiva de los consumidores y usuarios. Si bien la protección general del consumidor como parte débil en la relación contractual ha sido impulsada por el Derecho de la Unión Europea, es relevante analizar cuál es el tratamiento constitucional que se otorga a estos mecanismos en los distintos ordenamientos jurídicos de los Estados Miembros. Resulta de especial interés centrar el foco en las Constituciones italiana y española ahora que se celebra su 70 y 40 aniversario, respectivamente. Una primera parte de este trabajo abordará una visión general del tratamiento constitucional que se otorga a la protección del consumidor en ambas Cartas Magnas, y una segunda parte se centrará en el posible encaje constitucional de los mecanismos de tutela colectiva del consumidor en Italia y España.

The aim of this paper is to study the regulation that consumer protection has in both the Italian and Spanish Constitutions with special attention to the procedural mechanisms for consumer collective redress. Although general protection of the consumer as a weak party in the contractual relationship has been fostered by the European Union, it is relevant to analyse what constitutional treatment is given to these mechanisms in the different legal systems of the Member States. It is particularly interesting to focus on the Italian and Spanish Constitutions now that they are celebrating their 70th and 40th anniversaries, respectively. The first part of this paper will provide an overview of the constitutional treatment of consumer protection in both Norms, and the second part will focus on the possible constitutional fit of collective consumer protection in Italy and Spain.
