Inseguridad jurídica en algunas figuras del actual Derecho de religiosos

Abstract

El artículo trata sobre algunas figuras concretas del Derecho canónico sobre los religiosos, específicamente los siguientes: la ausencia de la casa religiosa aplicada a profesos temporales (can. 665 §1 CIC 1983), la exclaustración impuesta (can. 686 §3 CIC 1983), el rechazo del indulto de salida del instituto (can. 692 CIC 1983) y algunos supuestos de expulsión obligatoria del instituto (can. 695 §1 CIC 1983). El autor hace una valoración de la actual regulación en el CIC 1983 y sus deficiencias, las aportaciones de Congregación para los Institutos de Vida Consagrada y las Sociedades de Vida Apostólica (CIVCSVA) al respecto en el documento «El don de la fidelidad. La alegría de la perseverancia» y ofrece algunas propuestas de iure condendo.

The paper deals with some concrete figures of Canon Law regarding religious men and women, specifically the following: absence of the religious house applied to those in temporary vows (can. 665 §1 CIC 1983), the imposed exclaustration (can. 686 §3 CIC 1983), the rejection of the indult to leave the religious institute (can. 692 CIC 1983), and some cases of compulsory dismissal of the institute (can. 695 §1 CIC 1983). The author carries out a valuation of current regulation in CIC 1983 and its deficiencies, also of the contributions of the Congregation for the Institutes of Consecrated Life and the Societies of Apostolic Life (CICLSAL) regarding these issues in the document «The gift of fidelity. The joy of perseverance» and offers some proposals of iure condendo.
