La simulación del matrimonio y de sus propiedades esenciales (C.1101) en la canonística de lengua portuguesa postcodicial (1983-2013)

Abstract

Con esta Tesis Doctoral quisimos hacer una investigación científico-jurídica sobre las aportaciones de la canonística de habla portuguesa con respecto a la simulación del matrimonio. Fue nuestro intento estudiar la doctrina de los canonistas de habla portuguesa y reunir material inédito en el ámbito jurisprudencial, estudiarlo y sistematizar de modo crítico las ideas expuestas. Este es un estudio que viene a cubrir el hueco existente, hasta el momento, en la bibliografía canónica. Además, con nuestra investigación queremos prestar un servicio a los estudiosos del derecho y a los profesionales del ámbito canónico, ofreciéndoles un estudio que recoja materiales diversos y los ponga en relación: el código, el planteamiento doctrinal y la jurisprudencia, en todas las instancias. Esperamos así haber conseguido exponer de modo adecuado cuál es el enfoque del tema de la simulación del matrimonio en la canonística de habla portuguesa y en la jurisprudencia de los jueces de habla portuguesa, herramienta útil aun a la praxis procesal.

With this Doctoral thesis we wanted to do a scientific-legal investigation on the contributions of the Portuguese-speaking canonistic regarding the simulation of marriage. It was our attempt to study the doctrine of the Portuguese-speaking canonists and to gather unpublished material in the jurisprudential field, study it and critically systematize the ideas presented. This is a study that comes to fill the gap, so far, in the canonical bibliography. In addition, with our research we want to provide a service to law scholars and professionals in the canonical field, offering them a study that collects various materials and puts them in relation: the code, the doctrinal approach and jurisprudence, in all instances. In this way, we hope we have managed to adequately expose the focus of the issue of the simulation of marriage in Portuguese-speaking canonistic and in the jurisprudence of Portuguese-speaking judges, a useful tool even in procedural practice.
