Protección de los datos de salud en los tiempos de la covid-19: ¿ha acelerado la pandemia el necesario cambio de paradigma?

Abstract

La pandemia provocada por el virus SARS-CoV-2 ha mostrado, en cierto modo, el fracaso de la tecnología, pero, al mismo tiempo, su lado más humano, ya que aquélla, si bien se ha visto incapaz de predecir el impacto del virus, ha sido la herra- mienta que no solo ha permitido a muchos continuar con su actividad profesional, sino a casi todos mantener las relaciones familiares y de amistad. Este nuevo escenario que nos deja la pandemia abre una esperanza para el humanismo frente al transhumanismo, al mostrarnos una vez más la fragilidad y vulnerabilidad del ser humano. Y, en este contexto, además, se ha visto favorecido el cambio de paradigma en la investigación con datos de salud, pudiéndose afirmar ya que se instaura un nuevo modelo que a través de la seudonimización permite conciliar los derechos individuales y el interés colectivo.

The pandemic caused by the SARS-CoV-2 virus has shown, in a way, the failure of the technology, but, at the same time, its most human side. Although the technology has been unable to forsee the impact of the virus, it has been the tool which has allowed for many to continue with their professional activity and for almost all to maintain family and friendship relationships. This new scenario that the pandemic leaves us opens a hope for humanism against transhumanism, by showing once again the fragility and vulnerability of the human being. And, in this context, in addition, the paradigm shift in research with health data has been favored. There can be affirmed that a new model is established, because through pseudonymization individual rights and collective interest can be reconciliated.
