Estudio y evolución del contrato en Roma

Abstract

Este trabajo se centra en los orígenes y antecedentes de los contratos y de sus figuras más importantes con especial atención a la compraventa y sus características. El análisis empieza con el origen de los contratos como una de las fuentes de las obligaciones y así figuraba en las Instituciones de Gayo, que fue el primer texto en el que se hizo referencia a este tipo de contrato. Más adelante hago una introducción a los contratos consensuales para después centrarme más profundamente en la compraventa y sus características principales así como en las obligaciones de deudor y acreedor y en los pactos añadidos a la compraventa. Tras esto hago un estudio de los derechos reales de garantía y de las arras en particular. A lo largo de todo el trabajo pretendo hacer una comparativa constante entre el Derecho Romano y la situación actual que en muchas veces varía solo mínimamente.

This paper focuses in the origins and in the background of contracts and its main features with especial emphasis on sale and purchase contract and its characteristics. The analysis begins with the origins of contracts as one of the sources of obligations, and thus appeared in the Institutions of Gaius which was the first text in which this contract was mentioned. Then I continue with an introduction to consensual contracts as a previous step to focus on sale and purchase contracts and its main features as well as seller and purchaser obligations and in the attached covenants to these contracts. After this I do a study on the real guarantee rights and in the earnest money agreement in particular. Throughout the whole work I intend to do a constant comparative between Roman law and the current situation that has barely changed along the history.
