Función instrumental de la inteligencia artificial en la determinación de los conceptos jurídicos indeterminados

Abstract

Los conceptos jurídicos indeterminados constituyen una técnica legislativa que requiere ser individualizada. En la actualidad su matización se apoya en los instrumentos facilitados por la robótica y la inteligencia artificial. Aunque los esfuerzos en la configuración de la computación se orientan y refuerzan para conseguir unos conocimientos y razonamientos semejantes al humano, es necesario el dialogo permanente entre el funcionario público y el contribuyente con la finalidad de ponderar los parámetros existentes desde ambas posiciones lográndose con ello la fidelidad a los principios de igualdad y justicia tributaria

: Undetermined legal concepts constitute a legislative technique that needs to be individualized. Nowadays its nuance is supported by both the tools provided by robotics and artificial intelligence. Although the efforts in the configuration of computing are oriented and reinforced to achieve knowledge and reasoning similar to the human one, it is necessary the permanent dialogue between the public official and the taxpayer with the purpose of pondering the existing parameters from both positions, thus achieving fidelity to the principles of equality and tax justice.
