El turismo colaborativo: la vivienda de uso turístico y sus límites regulatorios ante la libre competencia.

Abstract

En el presente trabajo de fin de grado se han examinado las nuevas tendencias de consumo presentes en el mercado actual sujeto a constantes procesos de cambio, tal y como se ha puesto de manifiesto tras el impacto de la pandemia de COVID-19. De esta forma, a lo largo de los distintos apartados del trabajo se ha examinado la vertiente de la economía colaborativa relacionada con el panorama urbanístico y en particular, relacionada con la regulación a la que está sometida la vivienda de uso turístico. Así, se parte de la posición adoptada por las instituciones de la competencia, tanto a nivel nacional como autonómico, mediante la realización de un recorrido a través de los diversos dictámenes emitidos sobre esta materia. Una vez identificados cuáles son los instrumentos regulatorios y las materias cuya limitación puede constituir una amenaza potencial al correcto funcionamiento del mercado y de la libre competencia, se han puesto en relación con lo recogido por la normativa autonómica vigente en materia de vivienda colaborativa. De manera que se han puesto en relación las distintas perspectivas sobre una misma materia, acompañado todo ello de un breve análisis de los principales pronunciamientos judiciales de los últimos años. Se pretende ofrecer una visión completa del panorama regulatoria de las viviendas de uso turístico en España.

In the present final degree thesis the new compsuption trends present in the current market have been examined. Nowadays, the market is subject to constant and fast changes, as has become evident through the impact that the COVID-19 pandemic has had in the world’s markets. Therefore, throughout the different sections of the present thesis the urban dimension of collaborative economy has been examined, particularly the effects and the current regulation of touristic housing. The starting point has been examining the position stated by the competent authorities, both at a national and at a regional level, regarding this topic. In order to do so, a review of their latest reports issued on this matter has been carried out. Once the topics identified as potential threats to the functioning of the market have been clarified, they have been compared to the current legislation on touristic housing. This way, contrasting the existing views on the same topic can provide the present work with a wider perspective. All this comparative analysis has been complemented by an examination of the most recent rulings regarding the matter of touristic housing laws, with the aim of offering a complete view of the regulatory situation of touristic housing at a national level.
