El mercado mayorista eléctrico

Abstract

En este Trabajo de Fin de Grado, en adelante TFG, se pretende analizar las medidas jurídicas susceptibles de adoptarse para frenar la escalada de precios del mercado mayorista eléctrico, incluyendo la valoración de las medidas ya adoptadas. Su materia pertenece el ámbito del Derecho Administrativo.

Actualmente, la situación económica y medioambiental en la que nos encontramos nos exige actualizar la normativa y tratar de corregir los numerosos problemas y conflictos que han ido surgiendo a lo largo de las últimas décadas. La escalada de precios que está atravesando el mercado mayorista eléctrico ha llegado a unos niveles insostenibles, y se requiere un análisis exhaustivo que permita alcanzar soluciones y lograr la reducción de los costes. El sistema eléctrico está formado por muchas y muy diversas actividades, las cuales comienzan en la generación de la energía y terminan con la llegada de ésta al consumidor final. Este entramado de tareas implica a numerosos sujetos, quienes pertenecen a distintos sectores y cuyas ocupaciones son muy variadas.

Una de las cuestiones más relevantes en relación con el mercado mayorista es tratar de responder a dos preguntas. Resolver porqué se ha dado una escalada histórica en los precios de la energía y entender cómo funciona este mercado que ha derivado en dicha subida. A la espera de alcanzar una solución global que permita que toda la demanda se satisfaga mediante energías renovables, cabe recalcar la importancia de encontrar una solución para el mecanismo del mercado nacional eléctrico.

Finalmente, tiene cabida establecer el método de elaboración que se ha seguido a lo largo de este TFG, el cual está basado en la investigación académica, contraste de información, análisis exhaustivo de fuentes normativas y de jurisprudencia, para poder terminar con unas conclusiones que den solución a los numerosos interrogantes del sector eléctrico actual.

This Final Degree Project, hereinafter TFG, aims to analyze the legal measures that can be adopted to curb the escalation of prices in the wholesale electricity market, including the assessment of the measures already adopted. Its subject belongs to the field of Administrative Law.

Currently, the economic and environmental situation in which we find ourselves requires us to update the regulations and try to correct the numerous problems and conflicts that have arisen over the last decades. The escalation of prices that the wholesale electricity market is going through has reached unsustainable levels, and an exhaustive analysis is required to reach solutions and achieve cost reduction. The electricity system is made up of many and very diverse activities, which begin with the generation of energy and end with its arrival at the final consumer. This web of tasks involves numerous subjects, who belong to different sectors and whose occupations are very varied. It is very important to understand the framework we are dealing with.

One of the most relevant issues in relation to the wholesale market is to try to answer two questions. To solve why there has been a historical escalation in energy prices and to understand how this market works, which has led to such a rise. While waiting for a global solution that allows all demand to be met by renewable energies, it is important to stress the importance of finding a solution for the national electricity market mechanism.

Finally, it is necessary to establish the method of elaboration that has been followed throughout this TFG, which is based on academic research, contrast of information, exhaustive analysis of normative sources and jurisprudence, to be able to end with conclusions that give a solution to the numerous questions of the current electricity sector.
