Nuevos retos jurídicos internacionales en el espacio ultraterrestre: Hacia una explotación económica sostenible.

Abstract

Los últimos avances tecnológicos en el ámbito espacial han permitido una evolución exponencial de las actividades espaciales. Teniendo en cuenta las ambiciosas expectativas sobre el uso y la explotación del espacio ultraterrestre, el presente trabajo se centra en examinar la idoneidad del marco jurídico vigente. Para ello, se atiende a diversas cuestiones jurídicas relativas a la explotación de los recursos espaciales y la sostenibilidad de las actividades espaciales. En vista de las carencias identificadas, el trabajo pone de manifiesto la necesidad de reforzar la normativa vigente a fin de garantizar una explotación económica sostenible del espacio ultraterrestre. En este contexto, resultan de vital importancia los objetivos contenidos en la novedosa Agenda “Espacio 2030” de las Naciones Unidas.

Recent technological advances in the space field have allowed an exponential evolution of space activities. Taking into account the ambitious expectations on the use and exploitation of outer space, this paper focuses on examining the adequacy of the current legal framework. To this end, various legal issues related to the exploitation of space resources and the sustainability of space activities are addressed. In view of the shortcomings identified, the paper highlights the need to strengthen existing regulations in order to ensure a sustainable economic exploitation of outer space. In this context, the objectives contained in the new United Nations "Space 2030" Agenda are of vital importance.
