La responsabilidad internacional del estado en los casos de genocidio cultural : una cuestión polémica

Abstract

El presente trabajo lleva a cabo un detallado análisis acerca de la responsabilidad internacional del Estado, desde sus orígenes, pasando por sus distintas evoluciones hasta comprender que se entiende por responsabilidad internacional del Estado actualmente. Una vez contextualizada la responsabilidad internacional, se realizará un estudio del concepto de genocidio y las diferentes posturas doctrinales que se han ido manteniendo a lo largo del tiempo. La finalidad es entender el delito de genocidio, su regulación, y los mecanismos existentes para sancionarlo. Para ello, se traerá a colación la Convención para la Prevención y Sanción del Delito de Genocidio, así como las diferentes actuaciones llevadas a cabo por la Corte Penal Internacional en esta materia, haciendo referencia a varias de sus sentencias. Se estudiará detalladamente el funcionamiento de la Corte Penal Internacional con el fin de localizar posibles ineficiencias en el. Por otro lado, se analizará la función llevada a cabo por el Consejo de Seguridad de Naciones Unidas, focalizando el análisis en las sanciones internacionales impuestas por el mismo. El objetivo final es observar si la responsabilidad internacional del Estado como institución de Derecho Internacional constituye una herramienta necesaria y eficaz en la sanción y prevención del delito de genocidio.

The current paper carries out a detailed analysis of the international responsibility of the State, going from its origins and through the different evolutions, in order to recognize what can be understood by international responsibility of the State nowadays. Once the concept of international responsibility has been contextualized, an in-depth study of the crime of genocide will take place by understanding the different doctrinal positions that have been held over time. The aim is to acknowledge the crime of genocide, its regulation and the existing mechanisms for its punishment. For this matter, the Convention on the Prevention and Punishment of the Crime of Genocide will be brought up, as well as the different actions carried out by the International Criminal Court in this area, pointing out several of its rulings. The functioning of the International Criminal Court will be studied in detail in order to identify possible inefficiencies. Furthermore, the purpose carried out by the United Nations Security Council will be analyzed, placing focus on the international sanctions imposed by it. The final objective of the paper is to observe whether the international responsibility of the State, as an institution of International Law, constitutes a necessary and effective tool in the sanctioning and prevention of the crime of genocide.
