La garantía de los derechos del menor en los inicios de la carrera deportiva

Abstract

La figura del menor de edad es un aspecto concreto que el legislador ha ido regulando a partir de normas con el objetivo principal de protegerla. Tanto las normas internacionales como los propios textos estatales y autonómicos han ido configurando a lo largo de los años un marco jurídico de protección que consigue salvaguardar los intereses de los menores de edad en diferentes ámbitos en donde se incluye el deporte. Dentro del ámbito deportivo, el mecanismo de protección que más importancia ha alcanzado, tanto a nivel nacional como estatal, es el principio del interés superior del menor. Actualmente, el deporte que más repercusión despierta en España es el fútbol por lo que es en este deporte donde se encuentran más menores practicándolo ya sea de una forma amateur o federada. Debido a su relevancia, el legislador se ha visto en la obligación de regular la mayoría de los aspectos que tienen que ver con este deporte. Uno de los aspectos más importantes dentro de esta regulación es el apartado de las licencias deportivas. Estas licencias han dado lugar a la aparición del derecho de retención en favor de los clubes, el cual permite a estas entidades poder retener a sus jugadores por un tiempo determinado dentro de sus filas con independencia de la opinión del menor. El hecho de que las Comunidades Autónomas tengan la posibilidad de regular este ámbito ha provocado grandes diferencias entre menores deportistas simplemente por un criterio territorial. Además, muchas de estas regulaciones junto con la elaborada de forma subsidiaria por parte de la Real Federación Española de Fútbol son muy restrictivas para el menor, lo cual ha dado lugar a situaciones en donde se plantea si este conjunto normativo atenta contra el propio principio del interés superior del menor o no.

The figure of minors is a specific aspect that the legislator has been regulating on the basis of rules with the main objective of protecting them. Over the years, both international regulations and state and autonomous community texts have been shaping a legal framework of protection that manages to safeguard the interests of minors in different spheres, including sport. Within the field of sport, the most important protection mechanism at both national and state level is the principle of the best interests of the minor. Currently, the sport that has most repercussions in Spain is football, so it will be the one where most minors are playing it, whether in an amateur or federated form. Due to its relevance, the legislator has been obliged to regulate most of the aspects related to this sport. One of the most important aspects within this regulation is the section on sports licences. These licences have given rise to the appearance of the right of retention in favour of the clubs, which allows these entities to retain their players for a certain period of time within their ranks regardless of the opinion of the minor. The fact that the Autonomous Communities have the possibility of regulating this area has led to great differences between minor sportsmen and sportswomen simply because of territorial criteria. In addition, many of these regulations, together with the subsidiary regulations drawn up by the Royal Spanish Football Federation, are very restrictive for minors in this respect, which has given rise to situations in which the question arises as to whether or not this set of regulations goes against the very principle of the best interests of the minor.
