Análisis histórico-jurídico del concepto de representación política

Abstract

La representación política es una de notas esenciales dentro de las democracias contemporáneas. Todos los sistemas considerados como tales afirman fundarse sobre la representación de sus ciudadanos, configurando así un poder legislativo en donde la base electoral está presente, a través de sus representantes, a la hora de configurar el cuerpo legal de cada Estado. El objetivo, pues, de este ensayo es indagar sobre la veracidad de esta afirmación. Para ello se pretende analizar tanto desde un plano iuspolítico como histórico el concepto de representación política. Entender la representación, en tanto concepto o institución jurídica, requiere compulsoriamente acudir al Derecho privado como causa primera y de donde nace, por extrapolación analógica de las notas esenciales, la representación política. Será por esto por lo que este trabajo antes de adentrarse estrictamente en el estudio de la representación política superará la esfera privada de la representación, para poder así observar a continuación, a partir de en qué momento histórico, se configura la representación política sobre la esencia privada de la representación. La pretensión de este escrito será demostrar el proceso evolutivo de la representación política y justificar cómo y a partir de cuándo la relación de representación en la esfera política comienza a superar las notas esenciales de la representación privada configurando una relación entre elector y representante alejada de cualquier carácter representativo.

Political representation is one of the essential pillars of contemporary democracies. All systems considered as such claim to be grounded on the representation of their citizens, thus forming a legislative power in which the electoral body is present, through its representatives, when configuring the legal body of each State. The aim of this essay is to investigate the veracity of this statement. To do so the concept of political representation would be analysed from both a legal and historical perspective. Understanding representation, as a concept or legal institution, requires compulsory recourse to private law as its primary cause and from which political representation arises by analogical extrapolation of the essential notes. It will be for this reason that this work, before entering strictly into the study of political representation, will surpass the private sphere of representation, in order to observe then, from what historical moment, political representation is configured on the private essence of representation. The teleological pretention of this paper will be to demonstrate the evolutionary process of political representation and to justify how and from when the relationship of representation in the political sphere begins to overcome the essential notes of private representation shaping a relationship between elector and representative away from any representative character.
