El impacto de las nuevas tecnologías en el proceso. El Blockchain y celebración de la vista digital

Abstract

El presente trabajo tiene por objeto reflexionar sobre el impacto de las nuevas tecnologías en la justicia y en la aplicación del derecho. Son múltiples los beneficios y muchas las posibilidades que este nuevo contexto tecnológico ofrece al ámbito jurídico como veremos. Ahora bien, todas esas utilidades y ventajas no están exentas de riesgos y problemas y el reto al que se enfrenta el jurista consiste en obtener el máximo provecho de estas herramientas sin que ello implique una merma de los principios y las garantías del proceso ni una vulneración de los derechos fundamentales. A lo largo de este trabajo analizaremos la forma en que las más recientes innovaciones tecnológicas encuentran su desarrollo y cobran su significado, tanto en la manera de administrar justicia, como en el desarrollo del proceso mismo. Centrándonos en este último apartado, nos detendremos en estudiar dos aspectos concretos donde el impacto de las nuevas tecnologías se ha dejado sentir con mayor importancia a nuestro criterio: por un lado, la celebración de las vistas y los actos procesales en general y, por otro, los medios probatorios que tienen acceso al procedimiento judicial, haciendo una especial mención a la tecnología Blockchain, su concepto, aplicaciones y las posibilidades de conseguir su aportación al proceso como medio de prueba.

The aim of this study is to analyze the impact of modern technologies on justice and law enforcement. As we shall see, there are many benefits and possibilities that this new technological context offers to the legal field. However, all these benefits and advantages are not free of risks and problems, and the legal practitioner is faced with the challenge of getting the most out of these tools while respecting the principles and guarantees of the process and not violating fundamental rights. Throughout this paper we will analyze how the most recent technological innovations find their development and significance, both in the way justice is administered and in the development of the process itself. Focusing on the latter section, we will study two specific aspects where the impact of new technologies has been felt with greater importance to our understanding: on the one hand, the holding of hearings and procedural acts in general and, on the other, the evidentiary means that have access to the judicial procedure, making special mention of Blockchain technology, its concept, uses and the possibilities of achieving its contribution to the process as a means of evidence.
