Garantías reales sobre Propiedad Intelectual y Propiedad Industrial: una aproximación a la hipoteca mobiliaria sobre inmateriales

Abstract

A lo largo de las últimas décadas, la acelerada carrera por la innovación tecnológica y el desarrollo del comercio han transformado el paradigma de los sistemas de producción. Cada vez es más frecuente situar activos intangibles, como los derechos de autor o las patentes, en el núcleo de muchas corporaciones y transacciones tanto nacionales como multinacionales. En este sentido, apostar por el potencial de estos bienes es clave para reforzar la capacidad financiera de las empresas e impulsar el crecimiento económico. No obstante, existe mucho desconocimiento por parte de los operadores del tráfico jurídico en torno a esta realidad. Por esta razón, este trabajo presenta un estudio de la situación actual de los derechos reales de garantía sobre activos de propiedad intelectual e industrial en aras de acercar esta figura a los sujetos del mercado financiero y promover su confianza.

Over the last few decades, the rapid race for technological innovation and the development of trade have transformed the paradigm of the production systems. Intangible assets, such as copyrights or patents, are increasingly placed at the core of many corporations and transactions, both national and multinational. In this sense, betting on the potential of these assets is key for strengthening the financial capacity of companies and boosting economic growth. However, there remains a great deal of misunderstanding regarding this reality by the operators of the legal traffic. For this reason, this paper presents a study on the current situation of security in rem rights over intellectual and industrial property assets in order to bring this figure closer to the actors of the financial market and promote their confidence.
