La Ley de Excavaciones arqueológicas de 1911

Abstract

Para la conservación del Patrimonio Histórico Español, su estudio y disfrute, resulta fundamental su protección. Esta protección es y ha sido dispensada por las múltiples leyes, que, desde tiempos remotos, y, con medidas cada vez más específicas y detalladas han ido delimitando el concepto de Patrimonio Cultural. El mismo ha experimentado una amplia evolución y se ha visto afectado por los complejos y diversos momentos históricos. En este trabajo se pretende hacer un estudio íntegro de la progresiva elaboración, concreción y tutela jurídica que la Ley de Excavaciones Arqueológicas de 1911 dispensó al Patrimonio Histórico Español integrándose así en el ordenamiento jurídico en materia histórico-artística, y erigiéndose como una clara precursora de la actual Ley 16/ 1985, de 25 de junio, del Patrimonio Histórico.

For the conservation of the Spanish Historical Heritage, its study and enjoyment, its protection is essential. This protection is and has been granted by multiple laws, which, since ancient times, and with increasingly specific and detailed measures, have been defining the concept of Cultural Heritage. It has undergone extensive evolution and has been affected by complex and diverse historical moments. This study intends to make a comprehensive investigation of the progressive elaboration, concretion and legal protection that the Archaeological Excavations Law of 1911 dispensed to the Spanish Historical Heritage, integrating itself into the legal system in historical-artistic matters, and establishing itself as a clear precursor of the current Law 16/1985, of June 25, on Historical Heritage.
