Abstract

En este Trabajo de Fin de Máster (“TFM”) se pretende dar respuesta a las diferentes cuestiones que se plantean desde un punto de vista estrictamente jurídico. Para ello, se ha mantenido la estructura inicial presentada. Así, el trabajo estará dividido en tres secciones diferentes -sección A, sección B y sección C- y, cada una de estas secciones, a su vez, se encontrará subdividida en cuestiones específicas. Concretamente, nueve en la sección A y cinco en cada una de las secciones B y C. Las tres secciones objeto de estudio describen tres escenarios diferentes para el Grupo Castilla y el objetivo no es otro que, teniendo en cuenta las circunstancias de cada uno de ellos, dar una solución adecuada y conforme a Derecho. Para alcanzar este objetivo, se hará uso de la legislación nacional aplicable, así como de la jurisprudencia y doctrina que resulten de interés al caso.

This Master’s Thesis ("TFM") aims to answer the different questions that arise from a strictly legal point of view. To this end, the initial structure presented has been maintained. Thus, the work will be divided into three different sections - section A, section B and section C - and each of these sections will, in turn, be subdivided into specific questions. Specifically, nine in section A and five each in sections B and C. The three sections under study describe three different scenarios for the Castilla Group and the objective is none other than, considering the circumstances of each of them, to provide an appropriate solution in accordance with the law. In order to achieve this objective, use will be made of applicable national legislation, as well as case law and doctrine relevant to the case.
