Los límites y controles al poder

Abstract

Los estados democráticos se caracterizan por establecer una división de poderes y por su respeto a los derechos y libertades individuales. Ello exige la existencia de contrapesos que garanticen la independencia de los poderes legislativo, ejecutivo y judicial en el ejercicio de sus respectivas funciones. Sin embargo, en las últimas décadas, se ha constatado una tendencia a la hiperacción del poder ejecutivo, acrecentada por la necesidad de responder con rapidez a distintos desafíos. Resulta necesario, por tanto, analizar el equilibrio del sistema ante las diversas crisis que debe afrontar un país y comprobar si la respuesta que se está dando es la más adecuada.

Democratic states are characterised by a division of powers and respect for individual rights and freedoms. This requires the existence of checks and balances that guarantee the independence of the legislative, executive and judicial powers in the exercise of their respective functions. In recent decades, however, there has been a tendency for the executive branch to overreact, which has been exacerbated by the need to respond quickly to various challenges. It is therefore necessary to analyse the balance of the system in the face of the various crises a country faces and to check whether the response is the most appropriate.
