Proceso con menores : la valoración de la prueba pericial psicológica practicada a menores víctimas de hechos delictivos

Abstract

El presente trabajo aborda el análisis de las pruebas periciales psicológicas que se practican a menores que han sido víctimas de un hecho delictivo. En primer lugar, se analiza el marco legal en el que se engloba la práctica de estas pruebas. Por un lado, se señala el interés que existe en nuestro ordenamiento por la protección de las víctimas menores y, por otro, se analizan los principales delitos que sufren los menores y las consecuencias que de la comisión de los mismos se derivan para las víctimas. En segundo lugar, realizamos un breve análisis de los Sistemas de protección de menores víctimas en el ámbito europeo. Por último, se analiza la importancia de la práctica de pruebas periciales psicológicas en el marco del proceso penal y el modo de practicar dichas pruebas, así como la valoración del informe pericial y la importancia y credibilidad que el juez le otorga en el seno del proceso.

The present essay tackles with the analysis of the expert evidence on psychology practiced on minors who have been victims of a crime. First, we analyze the legal framework comprehending the practice of this kind of evidence. On the one hand, we point out the interest given by law to the protection of minor victims and, on the other hand, we analyze the main crimes suffered by minors and the consequences originated to them after having being victim of a crime. Second, we make a brief review of the Minor´s protection systems from a European scope. Finally, we analyze the importance of the practice of expert evidence on psychology in the frame of the criminal process and the way of practicing this kind of evidence, as well as the evaluation of the expert report on psychology and the importance and credibility given to it by judges.
