LA EFICACIA PREVENTIVA DEL EFECTO DISUASORIO DE LOS MECANISMOS LEGALES DE PROTECCIÓN FRENTE A LOS CRÍMENES DE VIOLENCIA SEXUAL EN TELA DE JUICIO

Abstract

La violencia sexual en conflictos armados y la impunidad tradicionalmente relacionada a la misma pueden calificarse como una constante a lo largo de la historia. El presente conflicto entre Rusia y Ucrania y las violaciones de derechos humanos cometidas con motivo del mismo ha evidenciado las deficiencias existentes en el sistema internacional de protección de los derechos de las víctimas. Ello no obsta a que no pueda tomarse este conflicto como un punto de inflexión en la materia para la protección a los derechos humanos.

Así, el objetivo principal de investigación del presente trabajo consiste en determinar hasta qué punto puede la disuasión prevenir la comisión de estos crímenes, tomando como punto de inflexión la reacción internacional a la violencia sexual ejercida por los soldados rusos en Ucrania. A fin de su consecución, se formulan dos objetivos de investigación específicos u objetivos secundarios de investigación: 1) Analizar la capacidad disuasoria de estos mecanismos como método de prevención contra la violencia sexual respecto a otras medidas preventivas y 2) Analizar el funcionamiento de los actuales mecanismos jurídicos de sanción de los referidos crímenes internacionales en el caso de Rusia y Ucrania.

Conflict-related sexual violence and the impunity traditionally associated with it can be described as a constant throughout history. The present conflict between Russia and Ukraine and the human rights violations committed in connection with it have highlighted the shortcomings of the international system for the protection of the rights of victims. This does not mean that this conflict cannot be seen as a turning point in the field of human rights protection.

Thus, the main research objective of this paper is to determine to what extent deterrence can prevent the commission of these crimes, taking as a turning point the international reaction to the sexual violence committed by Russian soldiers in Ukraine. In order to achieve this, two specific research objectives or secondary research objectives are formulated: 1) To analyze the deterrent capacity of these mechanisms as a method of prevention against sexual violence with respect to other preventive measures and 2) To analyze the functioning of the current legal mechanisms of punishment of the above-mentioned international crimes in the case of Russia and Ukraine.
