Discernimiento y Consentimiento matrimonial: cuestiones relativas a la discreción de juicio exigida para el matrimonio.

Abstract

El consentimiento es el acto fundante del matrimonio, que ningún poder humano puede suplir. A partir de la definición del consentimiento contenida en el c.1057, el artículo analiza la estructura y requisitos de este peculiarísimo acto de voluntad, que exige el ejercicio de actividades racionales -de conocimiento, valoración, ponderación, discernimiento y juicio- y una verdadera elección no una mera opción- por parte del contrayente. Asimismo, se abordan cuestiones como la relevancia jurídica de la ausencia actual de discernimiento por una absoluta falta de reflexión a la hora de contraer matrimonio, la delimitación precisa del objeto del discernimiento previo a la decisión de casarse, el papel del amor conyugal en la emisión de un válido consentimiento matrimonial. Por último, se incluye una reflexión sobre los retos que provoca la generalización de las nuevas tecnologías entre los jóvenes y su incidencia en el desarrollo de las facultades cognitivas y críticas de los llamados nativos digitales.

Discernment and matrimonial consent: questions concerning requested discretion of judgment for marriage Matrimonial consent is the act of the will that makes marriage; no human power is able to supply this consent. According to the definition of consent given in c. 1057, this article deeps into the structure and requests of this very particular act of the will, which demands rational actions to know, evaluate, ponder, discern and judge -, and a real election not just mere option, on the side of the bride and groom. It also deals with questions such as the juridical relevance of actual absence of discernment due to absolute lack of reflection when affronting marriage; the precise delimitation of the object of discernment previous to marriage decision; the roll of love when expressing a valid matrimonial consent. Lastly we include a reflection on the challenges emerging from a generalized use of new technologies amongst young people and its consequences on the development of the cognitive and critical faculties in the so called digital natives.
