La eutanasia. Análisis de la legislación española, compatibilidad con un sistema de cuidados paliativos y estado en el derecho comparado.

Abstract

En este trabajo de fin de grado trataremos de crear una fuente de información secundaria a la que la comunidad pueda acceder para comprobar el estado de la eutanasia, el suicidio asistido y los cuidados paliativos en España y en el mundo, también trataremos de acercar la realidad de los cuidados paliativos a aquellas personas que no estén familiarizadas con ellos.

El trabajo comenzará con un análisis del derecho comprarado para la eutanasia y el suicidio asistido, analizaremos la situación española y luego presentaremos los cuidados paliativos en España y en el mundo. Terminaremos con una proyección de la posible integración de una ley de cuidados paliativos en el sistema español.

Podremos comprobar como a los cuidados paliativos les queda mucho recorrido en España y están en una situación muy precaria, también veremos como estos están establecidos por ley en países vecinos y en general en más estados de los que han legalizado la eutanasia o el suicidio asistido. Estudiaremos que una ley en España seria perfectamente compatible con la actual ley 3/2021, pero como también podría funcionar como solución completa si algún ejecutivo deroga la ley de la eutanasia.

In this thesis we will try to create a secondary source of information that the community can access to check the state of euthanasia, assisted suicide and palliative care in Spain and in the world, and we will also try to bring the reality of palliative care closer to those who are not familiar with it.

The work will begin with an analysis of the international law on euthanasia and assisted suicide, we will analyse the Spanish situation and then we will present palliative care in Spain and in the world. We will end with a projection of the possible integration of a palliative care law in the Spanish system.

We will see how palliative care has a long way to go in Spain and is in a very precarious situation. We will also see how palliative care is established by law in neighbouring countries and in general in more states than those that have legalised euthanasia or assisted suicide. We will study how a law in Spain would be perfectly compatible with the current law 3/2021, but how it could also work as a complete solution if any executive repeals the euthanasia law.
