Estudio de las posibles mejoras en la colaboración jurídica público-privada en los desarrollos urbanísticos en España

Abstract

La sostenibilidad y el urbanismo han sido términos muy alejados durante toda su historia. De hecho, no fue hasta prácticamente los últimos diez años, aproximadamente, con los compromisos internacionales que España adoptó en este campo, cuando realmente se ha visto una incidencia destacable de la sostenibilidad en el urbanismo. Asimismo, la sostenibilidad resulta imprescindible actualmente debido a la situación de emergencia climática en la que nos encontramos y que muchas organizaciones, entre ellas, la ONU o la Unión Europea, han reconocido. El presente estudio trata de buscar cómo mejorar la legislación española en materia de urbanismo para hacerla más sostenible de acuerdo con los Objetivos de Desarrollo Sostenible, ya que considero que preservar el recurso natural del suelo a través de una normativa sostenible podría servir de gran ayuda a la emergencia mencionada. Como resultado del trabajo, se ha observado que, debido al reparto competencial en este ámbito, hay determinadas Comunidades Autónomas que están adoptando medidas muy ambiciosas y positivas mientras que otras van a un ritmo más lento. Del mismo modo, se ha analizado el papel y las actuaciones del Estado y se han aportado posibles oportunidades para hacer más útil su intervención, respetando los límites de la Constitución Española. El método que se ha utilizado ha sido el análisis comparativo legislativo y la investigación para dar soluciones personales a esta problemática actual. En este sentido, se concluye que los esfuerzos por parte de las Administraciones Públicas españolas han sido positivos, aunque poco atrevidos y desde este trabajo se anima mediante las propuestas mencionadas u otras pertinentes, a seguir este camino en el que aún queda mucho por recorrer.

Sustainability and urban planning have been very distant terms throughout their history. In fact, it was not until practically the last ten/fifteen years, with the international commitments that Spain adopted in this field, that we have really seen a significant impact of sustainability in urban planning. Likewise, sustainability is currently essential due to the climate emergency in which we find ourselves and which many organisations, including the UN and the European Union, have recognised. This study seeks to improve Spanish legislation on urban planning to make it more sustainable in accordance with the Sustainable Development Goals, as I believe that preserving the natural resource of land through sustainable regulations could be of great help in the emergency. As a result of the work, it has been observed that, due to the distribution of powers in this area, there are certain Autonomous Communities that are adopting very ambitious and positive measures while others are moving at a slower pace. Similarly, the role and actions of the State have been analysed and possible opportunities have been provided to make its intervention more useful, while respecting the limits of the Spanish Constitution. The method used was comparative legislative analysis and research to provide personal solutions to this current problem. In this sense, it is concluded that the efforts on the part of the Spanish Public Administrations have been positive, although not very daring, and this work encourages, by means of the proposals or other relevant ones, to continue along this path in which there are still many opportunities to be taken.
