La voluntad negocial y la expresión de causa falsa en el negocio jurídico

Abstract

El trabajo se centra en la causa como el elemento esencial más debatido dentro de la teoría del negocio jurídico. Se analizan diferentes negocios con expresión de “causa falsa” y se presentan las teorías doctrinales y aplicaciones jurisprudenciales más relevantes del Tribunal Supremo relacionadas con esta, particularmente, en sede sucesiones, los cambios sobrevenidos en las relaciones familiares del testador y en sede contratos, las dificultades de no expresar la causa en el acuerdo.

The paper focuses on the cause as the most debated essential element within the theory of the legal business. Different businesses with expression of "false cause" are analyzed and the most relevant doctrinal theories and jurisprudential applications of the Supreme Court related to this are presented, particularly, in inheritance, the changes in the family relationships of the testator and in contracts, the difficulties of not expressing the cause in the agreement.
