La fachada : elemento controvertido de la propiedad horizontal

Abstract

Actualmente son muchas las personas que viven en comunidad, más concretamente, en régimen de propiedad horizontal. Ello implica la necesidad de convivencia entre los vecinos. Como en toda convivencia son muchos y muy diversos los conflictos que se originan por las distintas actuaciones, elementos y acuerdos que pueden adoptarse entre los copropietarios. Dentro de los elementos que configuran la propiedad horizontal, la fachada presenta una importancia fundamental. Al ser considerada un elemento común, no pueden realizarse en ella obras o modificaciones que la alteren. Con este trabajo analizaremos los principales conflictos fruto de la fachada y, de los diversos elementos que la integran, unificando los criterios jurisprudenciales y doctrinales que permiten resolverlos.

Nowadays there are many people who live in community, more specifically, in horizontal property regime. This implies the need for coexistence among neighbors. As in all coexistence there are many and very diverse conflicts that originate by the different actions, elements and agreements that can be adopted between the co-owners. Within the elements that make up the horizontal property, the façade is of fundamental importance. As it is considered a common element, it cannot be altered by works or modifications. With this work we will analyze the main conflicts arising from the façade and the various elements that make it up, unifying the jurisprudential and doctrinal criteria that allow them to be resolved.
