La protección jurídica del menor trans

Abstract

El presente Trabajo de Fin de Grado analiza la cuestión jurídica de los menores transexuales para tomar decisiones válidas con el fin de adecuar sus vidas a la orientación sexual verdaderamente sentida. Se estudiará la evolución legislativa en el reconocimiento de los derechos de las personas transexuales, y la normativa que se ha ido dictando con el fin de proteger al menor transexual y garantizar su interés superior y el derecho a la vida e integridad física cuando se producen conflictos de intereses entre la decisión del menor trans y las personas bajo cuya protección se encuentren y el personal médico. Así, se llevará a cabo un análisis de la situación de los menores en el ámbito registral, sanitario y educativo, con especial referencia a la Ley Trans, aprobada recientemente que ha introducido modificaciones relevantes. Para ello, se hará uso de diversas opiniones doctrinales, cuerpos legislativos y jurisprudencia asentada.

This Final Degree Project analyzes the legal issue of transsexual minors to make valid decisions to adapt their lives to the sexual orientation they truly feel. It will study the legislative evolution in the recognition of the rights of transsexual persons, and the regulations that have been issued in order to protect the transsexual minor and ensure their best interests and the right to life and physical integrity when conflicts of interest arise between the decision of the trans minor and the people under whose protection they are and the medical staff. Thus, an analysis of the situation of minors in the registration, health and educational fields will be carried out, with special reference to the recently approved Trans Law, which has introduced relevant modifications. For this purpose, use will be made of various doctrinal opinions, legislative bodies and settled jurisprudence.
