Salud Mental en el medio penitenciario. Tratamiento penitenciario en personas con TMG.

Abstract

El presente trabajo trata de abordar desde una revisión bibliográfica los factores psicológicos, sociales y biológicos que intervienen en aquellas personas que sufren un Trastorno Mental Grave (TMG) y que, además, han tenido alguna relación con el sistema penal y penitenciario. De esta forma, hemos analizado la repercusión sociosanitaria de este sistema en las tres situaciones que se pueden dar: ante la inimputabilidad del enfermo que cometió un delito debido meramente a su enfermedad; ante la semiimputabilidad del enfermo, pues su enfermedad repercutió significativamente en su comportamiento delictivo, pero sin llegar a anular su capacidad para delinquir o su responsabilidad penal; y ante situaciones de imputabilidad donde el TMG aparece una vez dictada sentencia firme.

Por ello, hemos tratado de explicar qué entendemos por enfermedad mental y su relación con el medio penal y penitenciario. Haciendo especial referencia a los dos Hospitales psiquiátricos existentes en España y a los diferentes programas y medios de reinserción social una vez la persona con un TMG entra en contacto con este sistema. Por último y de forma más específica, hemos indagado sobre la incidencia de la psicopatía, más concretamente de los rasgos psicopáticos existentes entre la población reclusa.

The present research tries to approach from a bibliographic review about the psychological, social and biological factors to take part in those people who suffer a Serious Mental Disorder (SMD) and who, in addition, have had some relationship with the penal and penitentiary system. In this way, we have analyzed the socio-sanitary repercussion of this system in three situations that can happen: in the absence of criminal responsibility of the patient who committed a crime merely due to his illness; before the patient's semi-imputability, since his illness had a significant impact on his criminal behavior, but without undermine his capacity to commit crimes or his criminal responsibility; and in situations of imputability where the SMD appears once a final judgment has been handed down.

For this reason, we have tried to explain what we understand by mental illness and its relationship with the penal and prison environment. Making special reference to the two existing psychiatric hospitals in Spain and the different programs and means of social reintegration once the person with a SMI comes into contact with this system. Finally, and more specifically, we have investigated the incidence of psychopathy, about the psychopathic traits existing among the prison population.
