Modificación de los límites de velocidad en ciertas autopistas del territorio español

Abstract

El objetivo de este TFG sería ver la viabilidad de redactar un nuevo Real Decreto que permita modificar los límites de velocidad dentro del territorio español. Hay países europeos en los que los límites de velocidad están por encima del de nuestro país e incluso un país como Alemania, carece de límites de velocidad en ciertas autopistas, conocidas como las “Autobahn”. Además, en Alemania intentaron sacar un proyecto para penar a aquellos que fuesen por debajo de una velocidad mínima, aunque finalmente no salió adelante. Por ello, mi finalidad es ver cómo sería el proceso legal para establecer un proyecto normativo bien motivado que permitiese mostrar que tanto la DGT como el Ministerio del Interior no están siendo objetivos con las necesidades sociales y que en ciertas carreteras del territorio español se podría circular a velocidades superiores o incluso suprimir las velocidades máximas. También se valorará la legalidad de establecer zonas de prueba durante periodos de tiempo y ver cómo afecta a la sociedad que en ciertas carreteras se supriman estos límites para poder extrapolarlo al resto de carreteras españolas.

The objective of this undergraduate thesis project would be to see the feasibility of drafting a new Royal Decree that allows to modify the speed limits within the Spanish territory. There are European countries where speed limits are higher than in our country and even a country like Germany, has no speed limits on certain highways, known as the "Autobahn". Moreover, in Germany they also tried to develop a project to penalize those who go below a minimum speed, but in the end it did not go ahead. There for, my purpose is to see how the legal process would be to establish a well-motivated draft law that would show that both the General Directorate of Traffic and the Ministry of the Interior are not being objective with the social needs and that on certain roads of the Spanish territory it would be possible to circulate at higher speeds or even to suppress the maximum speeds. We will also assess the legality of establishing test zones for periods of time and see how society is affected by the suppression of these limits on certain roads in order to extrapolate it to the rest of Spanish roads.
