El modelo de continuidad delictiva del proyecto de reforma del Código Penal

Abstract

Este trabajo estudia una figura delictiva de creación jurisprudencial que es objeto de reforma por parte del Proyecto de Ley Orgánica por la que se modifica la Ley Orgánica 10/1995, de 23 de noviembre, del Código Penal y que en estos momentos se está tramitando en las Cortes Generales, este es, el delito continuado. A través del mismo, se pretende un análisis de la evolución que esta modalidad delictiva ha sufrido en España. Para ello, se examinarán los criterios y requisitos que la doctrina, y sobre todo la jurisprudencia, han exigido para apreciar la continuidad delictiva. Se diferenciará el trato que el delito continuado recibe frente a otras figuras jurídicas de similar naturaleza, como el concurso de delitos y el delito en masa. Especial atención se otorgará a los delitos patrimoniales continuados; su naturaleza, fundamento y reglas aplicables, así como a la solución que propone la reforma del Código Penal y a las consecuencias que puede propiciar su entrada en vigor.

The target of this article is to analyse a jurisprudential offense creation that is subject to be amended by the reform of the Organic Law 10/1995, of 23 November, amending the Criminal Code, that currently is pending in the General Court: the continuing offence. Through this paper, the main goal is to achieve an analysis of the evolution of this ongoing criminal activity, In order to do this, the criteria and requirements, that the doctrine, and especially the jurisprudence, have required to appreciate the continuing offence, are going to be examine as well as the legal treatment continuing offence obtained compared to other legal forms of similar nature, such as concurrent offences and the mass offense. Special attention will be given to the continuing property crime in addition to its nature, basis, rules and the solution proposed by the reform of the criminal code besides the consequences that will lead its entry into force.
