Derecho a la intimidad en las relaciones laborales. Especial referencia a la videovigilancia

Abstract

En el presente estudio se realizará un análisis de la vulneración del Derecho a la Intimidad en el ámbito de las relaciones laborales; así como el gran impacto de la actual videovigilancia en el trabajo y cómo afecta esta a los Derechos Fundamentales de los trabajadores. Para ello será necesario indagar acerca de temas como su actual regulación en nuestro sistema español y la jurisprudencia existente al respecto, poniendo de manifiesto la contradicción existente y su necesidad de unificación. Posteriormente, se procederá a definir los límites que presenta el sistema de videovigilancia, lo cual determina el uso procedente o improcedente de estas medidas, y las correspondientes sanciones ante el incumplimiento por parte del empleador de estos límites. También será imprescindible investigar sobre el Derecho a la Protección de Datos y la cuestión de la monitorización. Por último, se tratarán una serie de temas controvertidos, tales como la videovigilancia en el servicio del hogar familiar; la videovigilancia en tiempos de teletrabajo; o qué ocurre cuando es el trabajador el que lleva a cabo las grabaciones de sonido y vídeo al empresario.

This study will analyse the violation of the right to privacy in the area of labour relations, as well as the great impact of current video surveillance in the workplace and how it affects the fundamental rights of workers. In order to do so, it will be necessary to investigate issues such as its current regulation in our Spanish system and the existing case law on the matter, focusing on its contradiction in previous times and its current consolidation. Subsequently, we will proceed to define the limits presented by the video surveillance system, which determines the appropriate or inappropriate use of these measures, and the corresponding sanctions in the event of non-compliance by the employer with these limits. It will also be essential to investigate the right to data protection and the issue of monitoring. Finally, a series of controversial issues will be dealt with, such as video surveillance in domestic service; video surveillance in times of teleworking; or what happens when it is the worker who carries out the sound and video recordings for the employer.
