La mediación como medio de resolución de conflictos familiares

Abstract

En la actualidad cada vez son más los conflictos generados en el seno del Derecho de Familia. Consecuentemente, para poner fin a los mismos existen nuevos instrumentos alternativos al litigio, destacando entre ellos la mediación, que constituye una de las vías más racionales de resolución de conflictos de índole familiar. Este instrumento actual y emergente no solo logra la pacificación de un conflicto en el que las emociones se pueden adueñar del proceso, sino que también satisface la necesidad urgente de reforma de la Administración de Justicia, aliviando el colapso de los últimos años.

En este sentido, este trabajo tratará, por un lado, de profundizar en el tema, haciendo un recorrido por el concepto y los rasgos generales de esta figura y, por otro lado, se abordará de forma específica la mediación familiar, sobre todo en las llamadas crisis familiares, área en la que actualmente se encuentra en auge. Por último, se estudiará el tratamiento que recibe el interés superior del menor en la mediación así como también los derechos que pueden ejercer en sede de conflictos familiares.

Nowadays, there are more and more conflicts generated within Family Law. Consequently, in order to put an end to them there are new alternative instruments to litigation, among them mediation, which is one of the most rational ways of resolving conflicts of a family nature. This current and emerging instrument not only achieves the pacification of a conflict in which emotions can take over the process, but also satisfies the urgent need for reform of the Administration of Justice, alleviating the collapse of recent years.

In this sense, this work will attempt, on the one hand, to delve deeper into the subject by reviewing the concept and general features of this figure and, on the other hand, it will deal specifically with family mediation, especially in the so-called family crises, an area in which it is currently booming. Finally, the treatment of the best interests of the minor in mediation will be studied, as well as the rights that they can exercise in family conflicts.
