Las limitaciones medioambientales en el registro de la propiedad

Abstract

Este trabajo analiza cómo la evolución en la concienciación y preocupación social por el medio ambiente se ha ido reflejando en el ordenamiento jurídico y cómo el legislador ha regulado, cada vez con mayor profundidad, detalle y precisión, aquellos espacios merecedores de especial protección por pertenecer al dominio público y/o por revestir un especial interés medioambiental.

La normativa de protección y conservación del medio ambiente ha ido estableciendo límites a la propiedad de aquellas fincas que se ven afectadas por protecciones medioambientales.

Se analiza cómo acceden esas protecciones al principal mecanismo que ofrece información sobre la situación de los inmuebles, el Registro de la Propiedad.

This paper analyzes how the evolution in the social awareness for the environment has been progressively reflecting in the Spanish Legal System and how the legislator has ruled, each time more detailed and accurately, in wake of the collective interest, those areas deserving of special protection due to its belonging to the public domain and/or its specific environmental value.

Regulations in force of protection and preservation of the environment as a collective interest or good, have been establishing and outlining some limitations to the property of those lands affected by environmental protections.

The paper analyzes how the environmental protections enter the main mechanism that offers information about the real estate situation, the “Registro de la Propiedad”.
