La fundamentación de la protección jurídica de los derechos de los animales y su regulación en la Ley de Bienestar Animal

Abstract

En el trabajo se abordan los Derechos de los animales a través del área de la filosofía del derecho. En la primera parte del trabajo, correspondiente a la fundamentación de la protección jurídica de los animales se realizará un recorrido histórico acerca de los Derechos de los animales y su concepción, para ver cómo ha evolucionado esta idea a lo largo de la historia. Posteriormente, se analizará el rol que tenemos los seres humanos para con los animales, cómo han sido concebidos durante gran parte de nuestra historia como cosas y, sin embargo, cómo a día de hoy podemos llegar a hablar de los animales como titulares de derechos y de qué derechos estamos hablando. En la segunda parte del trabajo denominada Marco legal se procederá a analizar la regulación conferida por el Anteproyecto de la Ley de Bienestar Animal, teniendo en cuenta si se otorga o no una verdadera protección jurídica y si se cumplen las finalidades pretendidas. Para finalizar, tras el análisis del Anteproyecto, se procederá a relatar aquellos aspectos que sí debiesen ser tenidos en cuenta a la hora de elaborar y regular un Anteproyecto o una Ley de Bienestar Animal que ofrezca una verdadera protección y seguridad jurídica.

In this paper, animal rights are approached through the field of the philosophy of law. In the first part of the work, which corresponds to the rationale for the legal protection of animals, a historical overview of animal rights and their conception will be carried out, in order to see how the idea of animal rights has evolved over the course of history. Subsequently, we will analyze the role that human beings have towards animals, how they have been conceived for a large part of our history as things and yet, how today we can talk about animals as holders of rights and what rights we are talking about. In the second part of the work, entitled Legal framework, we will proceed to analyze the regulation conferred by the Animal Welfare Act, considering whether or not it grants real legal protection and fulfils the intended purposes. Finally, once the Law is analyzed, we will proceed to describe those aspects that should be taken into account when drafting and regulating an animal welfare law that offers real protection and legal certainty.
