La quiebra del mundo jurídico tradicional ante el auge de la sociedad digital.

Abstract

En el presente trabajo se abordará la prematura, y aún desconocida, era digital en la que estamos viviendo y su repercusión, específicamente, en el mundo de lo jurídico. Se reflexionará como una realidad tan contemporánea ha sido capaz de propiciar la evolución y el cambio en la esencia del derecho y sus conceptos básicos. Cómo se ha puesto en jaque la seguridad y preservación de las garantías del derecho, dejándose asimismo obsoleta la regulación nacional e internacional respecto a los escenarios que derivan de la integración social y laboral de las nuevas inteligencias artificiales. Todo esto alterando la figura de los profesionales de Derecho, los cuales se ven abrumados por un clima de incertidumbre normativa respecto a lo que concierne a la responsabilidad jurídica de las inteligencias artificiales y al futuro y estabilidad de sus propias profesiones. Se analizarán así los retos regulatorios y éticos, así como las cada vez más plausibles amenazas con las que tendrá que lidiar el ámbito legal.

This paper will address the premature, and still unknown, digital era in which we are living and its repercussions, specifically, in the legal world. It will reflect on how such a contemporary reality has been able to bring about the evolution and change in the essence of law and its basic concepts. How it has jeopardized the security and preservation of the guarantees of law, making national and international regulation obsolete with respect to the scenarios derived from the social and labour integration of the new artificial intelligences. All this is altering the figure of legal professionals, who are overwhelmed by a climate of regulatory uncertainty regarding the legal liability of artificial intelligences and the future and stability of their own professions. Regulatory and ethical challenges will be analysed, as well as the increasingly plausible threats that the legal field will have to deal with.
