dc.description.abstractEl tema central de la presente tesis es la trata y la explotación de seres humanos. Un fenómeno global de dimensiones comparables a la antigua esclavitud, que constituye, no obstante, una realidad difícil de identificar que afecta a personas en situaciones vulnerables, especialmente mujeres y niños. Sin embargo, debido a su conexión con el tráfico clandestino de personas y con las organizaciones criminales, las víctimas de la trata son a menudo percibidas como una amenaza para la seguridad interna. En este contexto, la cierta “indefinición” del concepto de víctima de la trata contribuye a perpetuar su invisibilidad, obstaculizando que los Estados cumplan con las obligaciones de identificación y protección de estas personas. Partiendo de esta realidad, la primera parte de la tesis tiene por objeto el análisis del concepto jurídico internacional de trata de seres humanos y la perspectiva que configurara la trata de seres humanos como una de las más graves violaciones de los derechos fundamentales de la personas; que constituye, además, la base por la que la prohibición de la trata de seres humanos se configura como una de las obligaciones más claras del Derecho internacional de los derechos humanos. La segunda parte de la tesis está dedicada al estudio de la prohibición internacional de la trata y el sistema de protección derivado de dicha prohibición, donde se pone de manifiesto como desde el Derecho Internacional resulta posible realizar una aproximación al concepto de “victima de trata” que permita garantizar la identificación de estas víctimas y su protección. Dicho concepto supera los límites de la definición internacionalmente consensuada del fenómeno para integrar también a las víctimas de los delitos directamente relacionadas con las “actuales formas de explotación”. En todo caso, la consecuencia inmediata de la consideración de víctima es su protección y la tutela de sus derechos. En este sentido, y partiendo del desarrollo de los instrumentos internacionales existentes en el ámbito europeo, la tesis concluye con una propuesta de lege ferenda en el marco de la Unión Europea para el establecimiento de un estatuto de víctima de trataes_ES
dc.description.abstractTrafficking in human beings and current forms of exploitation are the main theme of the thesis. Trafficking in persons is a global phenomenon of a dimension comparable to that of the old slavery which predominantly affects women and children. Indeed, this situation takes many different forms and is difficult to identify in practice. In fact, the vagueness of the concept of trafficking perpetuates the invisibility of people involved in trafficking processes; it has hampered States complying with their obligations regarding the protection of trafficking victims. Furthermore, victims of human trafficking are very often perceived as a threat to internal security of countries, due to their connection with smuggling and organized crime. From this perspective, the first part of the thesis analyzes the legal concept of trafficking from the International Law approach, on the basis pf which it can be concluded that trafficking in persons is one of the grossest violations of human rights. In this context, the prohibition of trafficking in persons is one of the clearest obligations under International Human Rights Law. The second part of the thesis is focused on the study of the prohibition of trafficking and the protection system, through which the need to find a concept of "victim of trafficking" in order to ensure the identification of the victims and their protection has become apparent. In this regard, the proposed concept covers not just victims of trafficking in estrictu sensu, but equally victims of crimes that are directly linked to the "current forms of exploitation." In any case, the acknowledgment of a victim of trafficking means the accountability of the State to assist and protect the human rights of victims. In this respect, the thesis concludes with a proposal for lege ferenda to establish a trafficking victim statute in the European framework to fight trafficking in human beings.es_ES
