La Ley 8/2021: El nuevo marco normativo aplicable a las personas con discapacidad

Abstract

La Ley 8/2021, de 2 de junio, por la que se reforma la legislación civil y procesal para el apoyo a las personas con discapacidad en el ejercicio de su capacidad jurídica, tiene como objetivo mejorar la calidad de vida de las personas con discapacidad, garantizar su derecho a la igualdad de oportunidades, la inclusión social y la accesibilidad universal. La reforma trata la discapacidad como una cuestión de derechos humanos y establece una serie de medidas para garantizar el acceso efectivo a la justicia a estas personas. Entre las reformas más destacadas se encuentran la revocación de la figura de la tutela y la declaración de incapacitación, el nuevo enfoque de la guarda de hecho, la curatela y el defensor judicial, y la apuesta por la jurisdicción voluntaria, que garantiza un proceso ágil y aficaz.

Law 8/2021, of June 2, which reforms civil and procedural legislation to support people with disabilities in the exercise of their legal capacity, aims to improve the quality of life of people with disabilities, guarantee their right to equal opportunities, social inclusion and universal accessibility. The reform treats disability as a human rights issue and establishes a series of measures to guarantee effective access to justice for these persons. Among the most outstanding reforms are the revocation of the figure of guardianship and the declaration of incapacitation, the new approach to the de facto guardianship, the curatorship and the judicial defender, and the commitment to voluntary jurisdiction, which guarantees an agile and efficient process.
