El impacto de la LOPIVI en la protección legal de los menores

Abstract

En primer lugar, se hará una introducción a la protección legal de los menores en España, definiendo y diferenciando los conceptos de guardia y custodia y patria potestad. Tras ello, se analizará la violencia infantil y todos los procesos penales que afecten o modifiquen la guardia y custodia. También se hará referencia al interés superior del menor y al impacto que tiene la violencia en los menores. Tras introducir la protección legal y la violencia infantil, se hará una introducción a la LOPIVI, y a todos los cambios que introduce. En primer lugar, se explicarán los cambios más generales que introduce, tanto en la forma de proteger a los menores como en la forma de actuar frente a la violencia infantil. En segundo lugar, se explicarán las modificaciones legales más relevantes en materia civil y penal que introduce la LOPIVI. Una vez se hayan establecido los cambios más importantes que introduce la LOPIVI en la protección legal de los menores, se hará una reflexión sobre el impacto que ha tenido la LOPIVI en dicha protección, y si ha sido positivo o negativo. En las conclusiones se reflexionará sobre el impacto de la LOPIVI, y lo que ha supuesto para la lucha contra la violencia infantil su implantación en el ordenamiento jurídico español.

First, there will be an introduction to the legal protection of minors in Spain, defining and differentiating the concepts of guardianship and custody and parental authority. After that, child violence and all criminal proceedings that affect or modify the guard and custody will be analyzed. Reference will also be made to the best interests of the child and the impact of violence on children. After introducing legal protection and child violence, there will be an introduction to the LOPIVI, and all the changes it introduces. First, it will explain the more general changes it introduces, both in the way of protecting minors and in the way of acting against child violence. Secondly, the most relevant legal modifications in civil and criminal matters introduced by the LOPIVI will be explained. Once the most important changes introduced by the LOPIVI in the legal protection of minors have been established, a reflection will be made on the impact that the LOPIVI has had on this protection, and whether it has been positive or negative. The conclusions will reflect on the impact of the LOPIVI, and what its implementation in the Spanish legal system has meant for the fight against child violence.
