El proceso de liberalización aérea en España

Abstract

En este trabajo de fin de grado se busca realizar un análisis de la liberalización del sector aéreo a nivel europeo mediante el estudio de la normativa más relevante: directivas y reglamentos, así como ciertas sentencias de tribunales europeos que han tenido alto impacto en el tema. Se analizarán los principios y líneas maestras que puedan aparecer en el estudio de la normativa. Se tratarán de encontrar también los efectos que ha tenido cada elemento normativo en el proceso de liberalización. También se analizará cuáles son los principios o líneas maestras que se observen en las diferentes normas, si es que los hay. En Europa, el sector aéreo es crucial debido a su papel en la integración y el progreso económico de los países miembros. Es fundamental contar con un sistema de transporte aéreo confiable y seguro para mejorar la conexión entre las naciones europeas, lo que promueve el comercio, el turismo y la colaboración entre ellas. Por los volúmenes de facturación, el sector aéreo contribuye de manera significativa al empleo y al crecimiento económico. Al facilitar el acceso a regiones remotas y la movilidad de las personas en toda Europa, el transporte aéreo juega un papel importante en la promoción de la cohesión territorial y social. Para asegurar la seguridad, la eficiencia y el crecimiento sostenible del sector aéreo, tanto para los Estados miembros como para los ciudadanos europeos en su conjunto, es esencial establecer y mantener un marco jurídico sólido y armonizado a nivel europeo. Por ello, con el análisis de la normativa europea concerniente a este tema, observaremos cuál ha sido la forma predominante de legislación en el ámbito europeo y cuáles han sido los efectos que estas normas han tenido, para así analizar los posibles elementos comunes o transversales existentes en todas ellas.

The aim of this thesis is to analyze the liberalization of the aviation sector at European level through the study of the most relevant regulations: directives and regulations, as well as certain rulings of European courts that have had a high impact on the subject. The principles and guidelines that may appear in the study of the regulations will be analyzed. We will also try to find the effects that each regulatory element has had on the liberalization process. We will also analyze what principles or guidelines, if any, are observed in the different regulations. In Europe, the airline industry is crucial because of its role in the integration and economic progress of member countries. A reliable and safe air transport system is essential to improve connectivity between European nations, which promotes trade, tourism and collaboration between them. In terms of turnover, the airline industry makes a significant contribution to employment and economic growth. By facilitating access to remote regions and the mobility of people across Europe, air transport plays an important role in promoting territorial and social cohesion. To ensure the safety, efficiency and sustainable growth of the aviation sector, both for Member States and for European citizens as a whole, it is essential to establish and maintain a sound and harmonized legal framework at European level. Therefore, with the analysis of the European regulations concerning this subject, we will observe what has been the predominant form of legislation at the European level and what have been the effects that these rules have had, in order to analyze the possible common or cross-cutting elements existing in all of them.
