Abstract

El presente trabajo consta de cinco informes elaborados para diferentes partes en relación con el proceso edificatorio realizada por la promotora HOGAR, S.L.

El primero de ellos va dirigido al peatón que sufre el impacto de un martillo que cae de un operario de la obra. Solicita asesoramiento para saber qué agentes pueden ser los responsables de los daños que ha sufrido, las acciones que puede ejercitar y si está en plazo para ello.

El segundo de los informes va dirigido al trabajador que, realizando labores en la construcción, sufre una caída desde una altura considerable, ocasionándole diferentes daños. Solicita asesoramiento legal para saber quiénes pueden ser los responsables del accidente de trabajo que ha sufrido y ante qué jurisdicción puede interponer las acciones pertinentes.

El tercer y cuarto informe va dirigido a los adquirentes de las viviendas una vez terminada la obra, si bien se realizan en dos momentos distintos, analizando la responsabilidad por los daños existentes al momento de recibir las viviendas, y los que aparecen 5 años más tarde, respectivamente.

Por último, HOGAR, S.L. solicita asesoramiento legal para saber si la sociedad con la que pretende suscribir la intermediación de un crédito inmobiliario está realmente habilitada para ello, acompañado de un análisis de la legalidad y procedencia de las condiciones ofrecidas por dicha entidad, así como de los paquetes de garantías más comunes dada la naturaleza del préstamo.

This work consists of five reports for different parties in relation to the construction process carried out by the developer HOGAR, S.L.

The first of these is addressed to a pedestrian who suffers the impact of the fall of a hammer from a construction worker. He requests legal advice to find out which agents may be responsible for the damage suffered, the actions that he can take and whether he is within the time limit for doing so.

The second of the reports concerns a worker who, while carrying out construction work, suffers a fall from a considerable height which causes him various injuries. He requests legal advice to find out who may be responsible for the work-related accident he has suffered and before which court has jurisdiction for the actions that can be brought.

The third and fourth reports are addressed to the purchasers of the buildings once the works have been completed, although they are carried out at two different times, analysing the liability for the damages existing at the time of receiving the apartments, and those appearing 5 years later, respectively.

Finally, HOGAR, S.L. requests legal advice to find out whether the company with which it intends to intermediate in a real estate loan is really authorised to do so, accompanied by an analysis of the legality and suitability of the conditions offered by the said entity, as well as the most common warranty packages given the nature of the loan.
