dc.description.abstract | El procedimiento penal español se configura a día de hoy como una realidad com pleja, resultante de la aplicación por los operadores jurídicos de una amalgama de previsiones constitucionales, legales y reglamentarias, de acuerdos internacionales y de pronunciamientos multi jurisprudenciales (TEDH, TJUE, TC, TS). Esos procesos dan forma a la relación del Estado con sus ciudadanos, con el resto de Estados y consigo mismo (con los valores y garantías que le definen históricamente y que integran su identidad), cuando reacciona a los ataques a los bienes jurídicos protegidos por su legislación penal sustantiva. Este vasto contexto normativo y de actividad procesal, va mucho más allá de las previsiones de nuestra Ley de Enjuiciamiento Criminal que, superada por unos acon tecimientos que se desarrollan a un ritmo frenético y con dimensión global, se ve con tinuamente reinterpretada desde la redefinición de pilares como, por ejemplo, el sistema de fuentes, los sujetos capaces de delinquir, el papel de la víctima del delito o los mecanismos de interconexión de jurisdicciones y de colaboración entre ellas, cuestiones que provocan nuevas fórmulas de actuación procesal y de desarrollo de actividad judicial. | es-ES |
dc.description.abstract | The Spanish criminal procedure is configured today as a complex reality, resulting from the application by legal operators of an amalgam of constitutional, legal and regulatory provisions, international agreements and multi-jurisprudential pronouncements (ECHR, CJEU, TC , ST). Those processes give shape the relationship of the State with its citizens, with the rest of the States and with itself itself (with the values and guarantees that define it historically and that make up its identity), when it reacts to attacks on the legal rights protected by its substantive criminal legislation. This vast regulatory context and procedural activity goes far beyond the provisions of our Criminal Procedure Act which, overtaken by events that are developing at a frenetic pace and with a global dimension, is continuously reinterpreted from the redefinition of pillars such as, for example, the system of sources, the subjects capable of committing a crime, the role of the crime victim or the mechanisms of interconnection of jurisdictions and collaboration between them, issues that they cause new formulas of procedural action and development of judicial activity. | en-GB |
