En el presente trabajo, tras la exposición de los hechos más relevantes de las cinco sentencias en las que el Tribunal de Estrasburgo ha juzgado el sistema español de acogimiento familiar, se analiza la regulación del “derecho a vivir en familia” de los niños, tanto en las normas supraestatales como en la actual legislación española, para abordar, a continuación, algunas consecuencias relevantes de esta jurisprudencia en relación a nuestro sistema de protección a la infancia en tres aspectos: el concepto de familia (y la calificación como tal de la familia acogedora), la protección de la vida familiar en estos casos, y el interés superior del niño como consideración primordial. In the present work, after exposing the most relevant facts of the five judgments in which the Strasbourg Court has judged the Spanish foster care system, the regulation of the “right to live with the family” of children is analyzed, both in supra-state regulations and in current Spanish legislation, to conclude by highlighting some relevant consequences of this jurisprudence in relation to our child protection system in three aspects: the concept of family, the protection of family life, and the best interests of the child as the paramount consideration.
