Abstract

El recurso a los procesos colectivos en defensa de los intereses de incidencia social de los consumidores ha ido en aumento en los últimos tiempos y, de modo paralelo, se han ido visibilizando las quiebras que plantea su regulación. En este contexto, el legislador ha ido implementando reformas tendentes a la mejora del instrumento colectivo de acceso al proceso; sin embargo, estas no siempre se han llevado a cabo con acierto. Una buena muestra de ello la constituye la reforma del régimen de acumulación de acciones, ya que el modo en el que se ha articulado plantea innumerables dudas interpretativas.
