dc.description.abstract | La respuesta a los abusos sexuales cometidos por clérigos y la prevención para que no se repitan constituyen un reto de primer orden para la Iglesia. A esta labor no es ajeno el Derecho Canónico, que puede contribuir a crear un marco de buen gobierno y de erradicación de la arbitrariedad, a establecer mecanismos de control para la detección de conductas irregulares, y, en su caso, proceder a la sanción de los hechos delictivos, lo que exigirá a su vez establecer vías claras, accesibles y eficaces de denuncia, y también mejorar la aproximación penal, especialmente a nivel procesal. Este nuevo libro de la Asociación Española de Canonistas aborda algunas de estas cuestiones, desde la perspectiva del derecho penal canónico, tanto sustantivo como procesal. El volumen presenta y analiza las recientes reformas legislativas en este campo, profundizando en cuestiones como la delimitación precisa de conceptos como el abuso de autoridad o los adultos vulnerables, la obligación de denunciar a nivel civil y canónico, los procedimientos para la investigación del delito e imposición en su caso de la pena, el auxilio judicial, etc. También se presentan algunas iniciativas que buscan el logro de la justicia reparativa en estos casos. | es-ES |
dc.description.abstract | The response to sexual abuse committed by clergy and the prevention so that it does not happen again constitute a challenge of the first order for the Church. Canon Law is no stranger to this task, which can contribute to creating a framework of good governance and the eradication of arbitrariness, establishing control mechanisms for the detection of irregular conduct, and, where appropriate, proceeding to the sanction of criminal acts, which in turn will require establishing clear, accessible and effective channels for reporting, and also improving the criminal approach, especially at the procedural level. This new book from the Spanish Association of Canonists addresses some of these issues, from the perspective of canon criminal law, both substantive and procedural. The volume presents and analyzes recent legislative reforms in this field, delving into issues such as the precise delimitation of concepts such as abuse of authority or vulnerable adults, the obligation to report at a civil and canonical level, procedures for investigating crimes and imposition of the penalty, judicial assistance, etc. Some initiatives that seek to achieve reparative justice in these cases are also presented. | en-GB |
