DELITOS CONTRA LA LIBERTAD SEXUAL COMETIDOS POR MENORES DE 18 AÑOS

Abstract

Este estudio aborda la cuestión de los delitos contra la libertad sexual perpetrados por menores de 18 años. En primer lugar, se examinan las causas que podrían haber propiciado su aumento en los últimos años, entre las que destaca especialmente el acceso y consumo de la pornografía por los jóvenes. También se procura realizar un perfil psíquico de los menores autores de estos delitos para identificar los factores que contribuyen a su comportamiento. En segundo lugar, se realiza un estudio de la legislación española aplicable, concretamente de la LORPM, para ver cómo, mediante sucesivas reformas, ha evolucionado el trato a los menores autores de delitos sexuales y cómo afecta ello a la sociedad en general. En tercer y último lugar, se identifican y analizan los principales problemas legales y procesales relacionados con la responsabilidad penal de los menores en estos delitos sexuales. Entre estos problemas nos centraremos en la aplicación de eximentes, concretamente la eximente contenida en el art. 183 bis CP, en la prescripción de los delitos en relación con los arts. 132.2 CP y 132.1 párrafo tercero CP, y en el registro de antecedentes penales del menor.

This study addresses the issue of sexual offenses committed by minors under 18 years of age. Firstly, it examines the possible causes that may have led to their increase in recent years, among which the access to and consumption of pornography by young people stands out notably. An attempt will also be made to create a psychological profile of the minor offenders of these crimes to identify the factors contributing to their behavior. Secondly, a study of the applicable Spanish legislation will be carried out, specifically the LORPM, to understand how the treatment of minors who commit sexual offenses has evolved through successive reforms and how this affects society at large. Thirdly and finally, the main legal and procedural problems related to the criminal responsibility of minors in these sexual offenses are identified and analyzed. Among these issues, we will focus on the application of exemptions, specifically as outlined in article 183 bis CP, the statute of limitations for offenses in relation to articles 132.2 CP and 132.1 third paragraph CP, and the registration of the minor's criminal record.
