El derecho a la información veraz: Un análisis (jurídico) razonablemente pesimista
Abstract
La libertad para enviar y recibir información veraz es uno de los pilares de los sistemas democráticos y el fundamento de toda opinión pública consciente. En la actualidad, esta libertad vive un proceso de transformación debido al uso masivo de las nuevas tecnologías: casi cualquier ciudadano dispone de los medios técnicos para informar a la sociedad sobre distintas cuestiones, ocupando el papel clásico de los medios de comunicación de masas. Pero ello no significa que los tradicionales requisitos de veracidad y noticiabilidad no se les deban exigir por igual. Es más, hay nuevos riesgos que afrontar, particularmente los provocados por la desinformación y sus consecuencias, que por poner en peligro el sano debate público han llevado a los Estados a tomar medidas que podrían resultar aún más perjudiciales que el mal que pretenden combatir. De ahí que para comprender este nuevo paradigma sea imprescindible estudiar las reformas normativas y las resoluciones de los principales órganos judiciales, garantes últimos de estos derechos. The freedom to send and receive accurate information is one of the pillars of democratic systems and the foundation of an informed public opinion. Currently, this freedom is undergoing a transformation due to the widespread use of new technologies. Almost any citizen has the technical means to inform society about various issues, taking on the traditional role of mass media. However, this does not mean that the traditional requirements of truthfulness and newsworthiness should not be equally demanded of them. In fact, there are new risks to face, particularly those caused by misinformation and its consequences. These risks, by endangering healthy public debate, have led states to take measures that could be even more detrimental than the problem they seek to combat. Therefore, in order to understand this new paradigm, it is essential to study regulatory reforms and the rulings of the main judicial bodies, the ultimate guarantors of these rights.
