Derecho de la Competencia en la Era Digital: La Inteligencia Artificial como Aliada y Desafío
Resumen
La Inteligencia Artificial ha llegado para quedarse, introduciendo profundos cambios en el Mercado y la actividad empresarial. El Derecho se enfrenta al reto de mantenerse actualizado y acompañar esta transformación digital asegurando el correcto funcionamiento del mercado y la protección de los consumidores. Si la tecnología avanza dejando el Derecho atrás, la sociedad se enfrentará a problemas que será incapaz de resolver, generando incertidumbre y descontrol.
Con la introducción de la Inteligencia Artificial existen tanto oportunidades, por ejemplo, la detección de patrones de comportamientos anticompetitivos en el Mercado, como grandes retos. El Derecho debe encontrar la forma de mitigar riesgos como la colusión algorítmica o la influencia negativa de la IA en las prácticas anticompetitivas de manera que la IA pueda utilizarse con normalidad para el beneficio social y empresarial sin suponer una amenaza para los derechos y libertades fundamentales.
La regulación más reciente y novedosa sobre el tema es la Ley de Inteligencia Artificial aprobada en 2023 por la Unión Europea, aunque no entrará en vigor hasta 2026. Si bien aún es pronto para analizar los efectos de dicha ley en el entorno empresarial, en este trabajo se analiza, mediante la revisión bibliográfica y el análisis de la legislación y de la jurisprudencia, la relación entre la Inteligencia Artificial y el Derecho de la Competencia. Artificial Intelligence is here to stay, introducing profound changes in the market and business activity. Law faces the challenge of keeping up to date and accompanying this digital transformation, ensuring the correct functioning of the market and the protection of consumers. If technology advances leaving Law behind, society will face numerous problems that it will be unable to solve, generating uncertainty and lack of control.
With the introduction of Artificial Intelligence there are both opportunities, for example, the detection of anti-competitive behavior patterns in the market, and great challenges. Law must find ways to mitigate risks such as algorithmic collusion or the negative influence of AI on anti-competitive practices so that AI can be used normally for social and business benefit without posing a threat to fundamental rights and freedoms.
The most recent and novel regulation on the subject is the Artificial Intelligence Act passed in 2023 by the European Union, although it will not come into force until 2026. While it is still too early to analyze the effects of this law on the business environment, this paper analyzes, through a literature review and an analysis of legislation and case law, the relationship between Artificial Intelligence and Competition Law.
