La relación entre la Ley 12/2023 y el derecho de propiedad.

Abstract

Por primera vez desde la Constitución de 1978, la Ley 12/2023, de 24 de mayo, por el derecho a la vivienda, ofrece una regulación estatal del derecho a la vivienda recogido en el artículo 47 de la Constitución. En su texto, se introducen y se modifican numerosos artículos que inevitablemente afectan al derecho de propiedad contenido en el artículo 33 de la Constitución, lo que ha suscitado controversia en la comunidad jurídica. En este Trabajo se analizarán en profundidad los posibles conflictos de constitucionalidad que surgen con respecto a la intromisión de algunas medidas introducidas por la Ley 12/2023 en el contenido esencial del derecho de propiedad.

For the first time since the Spanish Constitution of 1978, the Law 12/2023, of May 24, for the right to housing, offers a state regulation of the right to housing set out in Section 47 of the Spanish Constitution. The legal text introduces and modifies numerous articles that inevitably have an impact on the right to property set out in Section 33 of the Spanish Constitution, which has raised controversy among the legal community. In this Work we will analyze in depth the possible constitutional issues that arise around the intromissions of several measures introduced by the Law 12/2023 in the essential content of the right to property.
