El testamento ológrafo: conflictos en torno a la autoría y capacidad, y análisis de los requisitos formales exigidos por la ley

Abstract

El presente trabajo examina la sucesión testamentaria a través de una forma específica del testamento: el testamento ológrafo. Por tanto, se lleva a cabo un análisis exhaustivo del concepto, implicaciones y características distintivas de este tipo de testamento en el marco legal español, destacando su singularidad en términos de privacidad y simplicidad. Asimismo, se realiza una revisión de los requisitos formales exigidos por el Código Civil para asegurar la validez legal del testamento y proteger la voluntad del testador. Por otro lado, se pone especial énfasis en las problemáticas generadas entorno a la capacidad y autoría del testador, dos aspectos cruciales que frecuentemente generan litigios. Se profundiza en los desafíos jurídicos que plantea la verificación de estos elementos, esenciales para la validez del documento testamentario. Además, se analiza cómo las tecnologías emergentes están redefiniendo los paradigmas tradicionales de la práctica testamentaria, sugiriendo posibles adaptaciones y reformas legales que podrían facilitar la adaptación de las formas de testar a los nuevos contextos sociales y tecnológicos, como la propuesta del testamento ológrafo en soporte digital.

This paper examines testamentary succession through a specific form of will: the holographic will. Thus, an exhaustive analysis of the concept, implications, and distinctive features of this type of will within the Spanish legal framework is carried out, highlighting its uniqueness in terms of privacy and simplicity. Additionally, a review of the formal requirements demanded by the Civil Code is conducted to ensure the legal validity of the will and to protect the testator's intent. Special emphasis is also placed on the problems related to the testator's capacity and authorship, two crucial aspects that often lead to litigation. The legal challenges posed by the verification of these elements, essential for the validity of the testamentary document, are explored in depth. Moreover, the way emerging technologies are redefining the traditional paradigms of testamentary practice is analyzed, suggesting possible legal adaptations and reforms that could facilitate the adaptation of the ways of will to new social and technological contexts, such as the proposal of the digital holographic will.
