El presente trabajo de fin de grado analiza meticulosamente la fase inicial del procedimiento ante la Corte Penal Internacional (CPI), enfocándose en evaluar si esta fase contribuye al objetivo de la CPI de instaurar justicia universal en el ámbito internacional. El análisis se centra en la estructura y funcionamiento de la CPI, abarcando su creación, fundamento jurídico, competencia, y los distintos órganos que la conforman, como la Presidencia, las Secciones, la Fiscalía y la Secretaría.
El estudio resalta la importancia de la fase preliminar del procedimiento, donde se evalúa la competencia, la admisibilidad y el interés de justicia de los casos presentados. Este proceso determina si un caso procede a juicio, lo cual es crucial para juzgar situaciones de extrema gravedad, como genocidios o crímenes de lesa humanidad. El papel del Fiscal es destacado, enfatizando su independencia y la necesidad de una colaboración efectiva con la Sala de Cuestiones Preliminares para asegurar un proceso justo y equitativo.
El análisis también discute el principio de complementariedad de la CPI, que permite a la Corte actuar solo cuando los sistemas judiciales nacionales son incapaces o están indisponibles para hacerlo. Además, se examina el principio de jurisdicción universal de la CPI, que le permite ejercer competencia sobre crímenes cometidos en cualquier parte del mundo, reforzando su mandato de justicia global.
A modo de conclusión, el trabajo argumenta que la fase inicial del procedimiento de la CPI es fundamental para su misión de combatir la impunidad a nivel internacional. Esta fase no solo sirve como filtro para determinar la seriedad y pertinencia de los casos, sino que también asegura que la CPI se mantenga como una institución de justicia efectiva y respetada a nivel mundial, contribuyendo así a la instauración de la justicia universal y al fortalecimiento del derecho internacional penal. This Bachelor’s Degree Final Project meticulously analyzes the initial phase of the procedure before the International Criminal Court (ICC), focusing on evaluating whether this phase contributes to the ICC's goal of establishing universal justice in the international arena. The analysis centers on the structure and functioning of the ICC, covering its creation, legal foundation, jurisdiction, and various constituent organs such as the Presidency, the Divisions, the Office of the Prosecutor, and the Registry.
The study highlights the importance of the preliminary phase of the procedure, where the jurisdiction, admissibility, and justice interest of the presented cases are assessed. This process determines whether a case proceeds to trial, which is crucial for adjudicating situations of extreme gravity, such as genocides or crimes against humanity. The role of the Prosecutor is emphasized, underscoring his independence and the need for effective collaboration with the Pre-Trial Chamber to ensure a fair and equitable process.
The analysis also discusses the principle of complementarity of the ICC, which allows the Court to act only when national judicial systems are unable or unavailable to do so. Additionally, the principle of universal jurisdiction of the ICC is examined, which enables it to exercise jurisdiction over crimes committed anywhere in the world, reinforcing its mandate for global justice.
In conclusion, the work argues that the initial phase of the ICC's procedure is fundamental to its mission of combating impunity at the international level. This phase not only serves as a filter to determine the seriousness and relevance of the cases but also ensures that the ICC remains an effective and respected institution of justice worldwide, thus contributing to the establishment of universal justice and the strengthening of international criminal law.
