Análisis de la legitimidad de la República Popular de China sobre el Mar de China Meridional

Abstract

El objetivo de este trabajo de fin de grado es concluir si desde la perspectiva del Derecho Internacional Público la República Popular de China tiene legitimidad sobre el mar de China Meridional.

La gran cantidad de islas, islotes y arrecifes, junto con la existencia de recursos naturales y puntos clave para las rutas marítimas han hecho de la disputa por el mar de China meridional una compleja lucha de poder. Estudiaremos la relevancia estratégica de la zona tanto para los actores regionales, especialmente para el gigante asiático, como para los extrarregionales y su importancia para la estabilidad en las aguas del sudeste asiático y, por ende, para la paz global. Así mismo, analizaremos el conflicto desde el derecho histórico y marítimo, atendiendo a los factores legales e históricos alegados por las potencias involucradas.

La soberanía sobe estas aguas supone una gran proyección geoestratégica para el Estado que la ostente y, por lo tanto, también un cambio en el paradigma internacional. Este trabajo de fin de grado pretende reflejar la actualidad de la situación y determinar cómo he indicado supra, si las reclamaciones de la República Popular de China sobre la “línea de nueve puntos” son o no legítimas.

The aim of this dissertation is to conclude whether the People's Republic of China has legitimacy over the South China Sea from the perspective of public international law. The large number of islands, islets and reefs, together with the existence of natural resources and key points for maritime routes have made the dispute over the South China Sea a complex power struggle. We will study the strategic relevance of the area for both regional actors, especially the Asian giant, and extra-regional ones, and its importance for stability in Southeast Asian waters and, therefore, for global peace. We will also analyse the conflict from the perspective of historical and maritime law, taking into account the legal and historical factors alleged by the powers involved. Sovereignty over these waters represents a major geostrategic projection for the state that holds it and, therefore, also a change in the international paradigm. This thesis aims to reflect the current situation and to determine, as I have indicated above, whether the claims of the People's Republic of China over the "nine-dash line" are legitimate or not.
